IMO® Trademark Usage Guidelines

Introduction

The trademarks of IMO® and Intelligent Medical Objects® are used in connection with products and services worldwide to signify the quality and excellence for which IMO® is known, and are property of Intelligent Medical Objects, Inc.  IMO® has obtained valuable rights through proper and continuous use of its trademarks.  Adherence to the following usage guidelines will help to maintain the integrity of our brands and preserve their value.

What is a trademark?

A trademark is a word, name, symbol, device, design or phrase adopted and used by IMO® to identify its goods and services and to distinguish them from the goods and services of others.  Trademarks, otherwise known as brands, are usually marked with either a ™ or an ® symbol (a ™ designates an unregistered trademark and an ® designates a registered trademark). While these generally refer to trademarks used in the United States, some trademarks may also be used and registered internationally.

Referential Trademark Usage

You may use IMO® trademarks to refer to IMO® products in marketing and promotional literature, print materials and other media provided that:

  • You adhere to these trademark usage guidelines
  • You do not disparage IMO® or IMO® products and services
  • You do not imply a relationship or association with IMO® that does not exist
  • You use appropriate notice on all trademarks and a footnote indicating that the trademark(s) is owned by Intelligent Medical Objects, Inc.

General Trademark Usage Guidelines

  1. Use appropriate markings.  Always designate the trademark with the appropriate ™ or ® symbol.  Also, the first usage or most prominent usage of an IMO® product name should be preceded by the IMO® master brand in the same typesize, font and color and used on the same line.

    Correct:  IMO® Medical Necessity

  2. Use IMO® trademarks as adjectives.  A trademark is an adjective that modifies a noun.  Always use IMO® trademarks as adjectives that describe the generic product, unless referring to IMO® as a company.

    Incorrect:  IMO’s iHealthSearch™

    Correct:  IMO® iHealthSearch™

  3. Attribute ownership of IMO® trademarks to IMO®.  When you refer to an IMO® trademark, please include a notice of trademark attribution where appropriate on all labeling, print collateral or other media:

    Correct:  IMO®, Intelligent Medical Objects® and IMO® logo are trademarks of Intelligent Medical Objects, Inc.

  4. Logos.  You may not use any IMO® logos without a trademark license from IMO®.  All usage of trademark logos shall be pursuant to these guidelines and any other guidelines applicable to that particular logo.  Please contact IMO if you are interested in a license to use an IMO® logo or you require further guidance on proper trademark usage.

IMO® Privacy Policy

Intelligent Medical Objects, Inc. ("IMO®") is committed to protecting your privacy. This Privacy Policy describes how IMO® protects the privacy and security of the personal and non-personal information that we obtain from users of this web site (the "Site").

IMO® has self-certified that our privacy practices are consistent with the U.S.-European Union Safe Harbor principles (http://en.wikipedia.org/wiki/Safe_Harbor_Principles).

Security

We understand that storing our data in a secure manner is essential. IMO® stores personal and non-personal data using industry standard physical, technical and administrative safeguards to secure data against foreseeable risks, such as unauthorized use, access, disclosure, destruction and modification.

Information We Collect

The Site collects two types of data: Personal Information and Non-Personal Information.

  1. Personal Information

    You may choose whether or not to submit Personal Information (such as your name, address, telephone number, or e-mail address) through the "Contact Us" and "Registration" pages of the Site.

  2. Non-Personal Information

    IMO® collects Non-Personal Information from Site users. This information is aggregated and does not allow you to be identified or contacted. We collect this information by placing a "cookie" on the browser of your computer.

    A cookie is a small file of information that a web site transfers to your computer for record-keeping purposes. The cookie itself does not contain any personally identifiable information, but may be used to tell when your computer has contacted the Site, thus enhancing your experience as a user of the Site. For instance, the Site's use of cookies allows you to avoid registering each time you visit the Site to download resources; you must only register once.

    Cookies can be disabled or deleted, but doing so will require you to re-register each time you visit the Site for downloads. The "Help" features on most browsers explain how you can delete, disable, or choose not to accept cookies.

How We Use the Data We Collect

  1. Personal Information

    Personal Information will be used solely for the purpose of responding to the inquiries that you submit to us via the "Contact Us" and "Registration" pages of the Site. Except as described in this section, Personal Information will not be disclosed to any third parties.

    Some Personal Information may be shared on occasion with outside lawyers, auditors, consultants and others that are hired to assist in supporting the Site or performing other functions necessary to operate our business. These recipients are bound to: (1) safeguard the personally identifiable information, (2) use it only for the purpose that IMO® specifies, and (3) return it or destroy it as soon as the need for the information expires.

    IMO® may be required to disclose Personal Information in response to a search warrant, subpoena or court order, or (1) to protect our legal rights, (2) to protect the security or integrity of our Site or systems, (3) to take precautions against liability, or (4) during emergencies if physical safety is believed to be at risk. Such disclosures will be made on a need-to-know basis, and IMO® will use reasonable efforts to direct such recipients to abide by IMO's Privacy Policy.

    IMO® reserves the right to transfer Personal Information if it sells its business to a third party. If such a sale occurs, we will use reasonable efforts to direct the purchaser to abide by IMO's Privacy Policy.

  2. Non-Personal Information

    In addition to the uses listed for Personal Information, above, IMO® may provide Non-Personal Information to third parties regarding the number of various types of requests for information regarding our services that we receive through the Site.

Links to Third-Party Sites

IMO links to third-party sites on its "IMO® Clients" page. IMO® is not responsible for linked sites' content, or for your use of the sites. If you choose to visit a linked site, we recommend that you review its privacy policy.

HIPAA Compliance

The Health Insurance Portability and Accountability Act of 1996 ("HIPAA") established new standards for healthcare privacy and security. Although IMO® is not directly subject to HIPAA's requirements, we receive protected health information ("PHI") from, and on behalf of, our customers that is subject to the protections of HIPAA. IMO® is committed to protecting the privacy and security of our customers' PHI in a manner that is consistent with their legal obligations under HIPAA. IMO has developed a privacy and security compliance program for our personnel that take into account HIPAA standards and reasonable practices in the healthcare industry.

Children's Privacy

This Site is not designed for or directed to children. IMO® does not knowingly collect or use any Personal Information from children under the age of 13. IMO® does not knowingly provide any Personal Information from these users, regardless of its source, to any third parties for any purpose whatsoever. No Personal Information should be submitted to the Site by users younger than 13 years old.

Notification of Changes

This Privacy Policy may be revised from time to time as (1) we add new features and services, (2) laws change, and (3) privacy and security practices evolve. We display a version number and a date in the upper right corner of this Privacy Policy page so that it will be easier for you to know when there has been a change. If we make any change to this Privacy Policy regarding use or disclosure of personally identifiable information, we will provide advance notice on the Site. Small changes and changes that do not significantly affect individual privacy interests may be made at any time.

Your Privacy Choices

When you submit Personal Information to the Site, you may receive materials regarding IMO's products and services by mail or e-mail. You may opt out of receiving these materials by visiting this web page's "Contact Us," or contacting us by e-mail at CustomerSupport@imo-online.com.

Updating Your Personal Information

You can always contact us to: (i) delete your Personal Information from our systems, (ii) update the Personal Information that you have provided to us, and (iii) change your preferences with respect to receiving information regarding IMO® products and services.
