Intelligent Medical Objects, Inc. (“IMO,” “we,” “us,” and “our”) is committed to protecting your privacy. This Privacy Policy describes how IMO protects the privacy and security of the personal and non-personal information that we obtain from users of our web site (the "Site") and users of our products and services (the “Applications”).

Intelligent Medical Objects, Inc. (“IMO,” “we,” “us,” and “our”) is committed to protecting your privacy. This Privacy Policy describes how IMO handles the personal and non-personal information that we obtain from you, the users of our U.S. based web site www.e-imo.com (the "Site").

The Site is controlled by us from our offices within the United States of America. We make no representation that the Site, the services or products or the content is appropriate or available for use in other locations, and access to them from jurisdictions where the services, products or content are restricted or is illegal is prohibited. Those persons and entities that choose to access the Site from other locations outside the United States do so on their own initiative and are responsible for compliance with applicable local laws.  

Your information collected through the Site may be stored and processed in the United States or any other country in which we or our subsidiaries, affiliates or service providers maintain facilities. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to (i) the transfer of information to the U.S. or any other country in which we or our subsidiaries, affiliates or service providers maintain facilities and (ii) to the use and disclosure of information about you as described in this Privacy Policy. 

This Privacy Policy sets out the basis on which any personal data we collect from you through the Site, or that you provide to us through the Site, will be processed by us. This Privacy Policy also makes disclosures concerning IMO’s collection of information, including personal information, that we collect:

  • on this Site;
  • in email, text and other electronic messages between you and the Site;
  • through mobile and desktop applications you download from this Site;

This Privacy Policy does not apply to information collected outside the Site, including by:

  • IMO pursuant to a separate contractual relationship for the license of IMO products or services;
  • IMO offline or through any means other than the Site, including or on any other website operated by any third party; or
  • any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Site.

By using the Site, you consent to the use of information that you provide us through the Site as described herein in accordance with this Privacy Policy. If you do not agree with our policies and practices, you should not use our Site. We do update this Privacy Policy from time to time so please review this Privacy Policy regularly. If we materially alter our Privacy Policy, we will notify you of such changes by contacting you through your user account e-mail address and/or by posting a notice on the Site.

Please read this Privacy Policy carefully to fully understand how we collect, share and protect information about you through the Site.  By accessing and using the Site, you agree that you have read and understand this Privacy Policy and that you accept and consent to the practices and uses or disclosures of information about you that are described herein.

Information We Collect ABOUT YOU AND HOW WE COLLECT IT

We collect several types of information from and about users of our Site, including information::

  • by which you may be personally identified, such as your name, postal address and email address, telephone number, your method of payment (but not account information) or any other identifier by which you may be contacted online or offline (“personal information”);
  • that is collected about you but individually does not identify you;
  • about your internet connection, the equipment you use to access the Site, and usage details;
  • through communications by you to us regarding the Site or any of our services or products, including responses to surveys that we might ask you to complete for research purposes;
  • in records and copies of your correspondence if you contact us (including email); and
  • through your responses to surveys that we might ask you to complete for research purposes.

You may also provide information to be published or displayed (“posted”) on public or membership areas of the Site, or transmitted to other uses of the Site or third parties (collectively, “User Contributions”).  Your User Contributions are posted on and transmitted to others at your own risk.  Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable.  Additionally, we cannot control the actions of other users of the Site with whom you may choose to share your User Contributions.  Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

As you navigate through and interact with our Site, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • details of your visits to the Site and the resources you access, including, but not limited to, your Internet protocol (IP) address, traffic data, location data, weblogs and other communication data, the date and time you accessed or left the Site, term searches and other use of the Site; 
  • information about your computer and internet connection, including your IP address, operating system and browser type;
  • details regarding your interactions with customer service, such as the date, time and reason for contacting us, transcripts of chat conversations, and if you call us, your phone number; and
  • information collected via the use of cookies (see section below “Our Use of Cookies” for further information) and other technologies.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). We currently do not track customers across third party websites to provide targeted advertising and therefore does not respond to Do Not Track (DNT) signals.

The information we collect automatically is statistical data and does not include personal information, but we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Site and deliver a better and more personalized service, including by enabling us to:

  • estimate our audience size and usage patterns;
  • store information about your preferences, allowing us to customize our Site according to your individual interests;
  • speed up or optimize your searches; and
  • recognize you when you return to our Site.

We may contract with third parties to help us manage, monitor and optimize the Site and measure the effectiveness of our communications and use of the Site. We may use cookies for this purpose (see section below “Our Use of Cookies” for further information).

By submitting a telephone number to us, you agree that a representative of IMO can contact you at the number you provide, potentially using automated technology (including texts/SMS messaging) or a pre-recorded message. Your consent is not an obligation to receive any of our services.

Our Use of Your Information 

The information that we collect and store relating to you is primarily used to enable us to provide our services to you in the best possible manner. In addition, we may use the information for the following purposes:

  • to communicate and provide you with information relating to our products and services (for example email notices regarding subscription renewals) and to offer you additional products and services;
  • to provide third parties with statistical information about the users of our Site;
  • to monitor and conduct an analysis of our Site traffic and usage patterns;
  • to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
  • to analyze trends and to improve our service; and
  • in any other way we may describe when you provide the information.

We may use the information we have collected from you to enable us to display advertisements to our advertisers' target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria. Please be sure to review any third party advertiser’s own privacy policies and procedures if you should choose to access their website or services. 

Our Disclosure of Personal Information to Third Parties

We may disclose your personal information to any affiliated business entities or third parties necessary to provide products or services to you. This includes, where applicable, our subsidiaries, holding company and its other subsidiaries (if any), as well as third parties involved in the administration and operation of our products and services. We may also disclose your personal information to other third parties, such as:

  • to protect or enforce our legal rights and policies, to protect or enforce the legal rights of a third party, or as we in good faith believe we are required to do so by law (such as to comply with a subpoena or court order, for example);
  • when we are contractually obligated to disclose it;
  • to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of IMO’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by IMO about our Site users is among the assets transferred;
  • for any other purpose disclosed by us when you provide the information; or
  • with your consent.

We may contract with various third parties who help us provide, maintain and improve the Site and such third parties may have access to your personal information in order to perform their services. For example, we may subcontract out production, fulfillment, analytics, reporting or other operations. 

Our Disclosure of Non-Personal Information to Third Parties

We may disclose non-personal information, in aggregate form, your geographical information such as city and zip code, or term search data to potential strategic partners, advertisers, investors, customers, and others, including developing information, statistics, compilations, summaries, surveys, abstracts, analytics, or combinations with or matches against other data, for use by such third parties, whether or not for financial gain. 

Our Use of Cookies

A cookie is a piece of text which asks permission to be placed on the hard drive of your computer. We use cookies to remember certain user information. This allows users of the Site to avoid logging in more than once, thereby saving time. All computers have the ability to decline cookies.  You may, at any time, disable or refuse to accept cookies by changing the preferences or settings on your web browser. If you choose to disable cookies, you will still be able to use the Site. However, you will not be able to fully take advantage of certain automation and other functionality features available in the Site.  

We also use Google Analytics, LeadLander and Marketo tracking pixel on the Site, amongst other third party data analytics service providers. And again, we do not use flash cookies. 

THIRD PARTY USE OF COOKIES

Some content or applications, including advertisements, on the Site are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies to collect information about you when you use our Site. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. 

We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

How We Protect Your Personal Information

We consider protecting the security of your personal information as very important. When you enter personal information into the Site, we encrypt that information using secure socket layer technology (sometimes referred to as “SSL”).

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

We follow generally accepted industry standards to protect personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we do not guarantee absolute security. We are not responsible for the unauthorized acts of others and we assume no liability for any disclosure of information due to errors in transmission, unauthorized third party access (such as through hacking) or other acts of third parties, or acts or omissions beyond our reasonable control.

Your Privacy Choices

When you submit personal information to the Site, you may receive materials regarding IMO’s products and services by mail or e-mail. You may opt out of receiving these materials by: (i) visiting IMO’s website (www.e-imo.com) and clicking the “Contact Us” tab; or (ii) contacting IMO’s customer support.

Updating Your Personal Information

You can always contact us to: (i) delete your personal information from our systems; (ii) update the personal information that you have provided to us; and (iii) change your preferences with respect to receiving information regarding our products and services.

Children’s Privacy

By using the Site, you affirm that you are at least 18 years of age or older.  We are not liable for any damages that may result from a user’s misrepresentation of age.

The Site is intended for health care providers and others in the healthcare field. Therefore, it is unlikely that children under the age of 18 will use the Site. Accordingly, we will not knowingly collect or use any personal information from children that we know to be under the age of 18. In addition, we will delete any information in our database that we know originates from a child under the age of 18.

If you are between the ages of 13 and 17, you, your parent, or your legal guardian may request that we deactivate any of your personal information in our database and/or opt-out from receiving communications from us. No one under age 13 is authorized to submit or post any information, including personally identifying information, on our Site. Under no circumstances may anyone under age 13 use our Site.  Parents or legal guardians of children under 13 cannot agree to this Policy on their behalf.  If you believe we might have information from or about a child under 13, please contact us at Customer Support at customersupport@imo-online.com.

Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of our Site that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to legal@imo-online.com.

Changes in Privacy Policy

This Privacy Policy is subject to change from time to time. We will notify you by email or in the Site whenever there is a material change in our Privacy Policy.
